These terms apply to your use of the ozeida.com site and what it offers: ozeida Academy, Sprezzatura and Capito. If you do not agree with them, do not use the site.
1. Who runs the site and what these terms cover
- The site is run by Bruno Villarreal, an individual, who operates under the trade name ozeida, with an address for notices at Baja California 635, colonia República Poniente, C.P. 25265, Saltillo, Coahuila, Mexico. In these terms we call him “ozeida”.
- ozeida Academy is the site’s space for courses and tutorials.
- Sprezzatura is the program of invited authors who write courses in the Academy. Anyone taking part as an author is also covered by the terms for authors (in Spanish).
- Capito is the new name of Explica: the Academy module that answers questions with explanations generated by an AI.
- These terms do not replace what you agree in writing with ozeida for a contracted service: that agreement prevails on what it says.
2. Accounts
- To save your progress or use Capito you need an ozeida Academy account. You sign in with a code we send to your email.
- You are responsible for your account details being yours and up to date, and for what is done from your account. If you think someone else got into it, write to us at contacto@ozeida.com.
- One account per person. Do not transfer or sell your account.
- How we handle your data, how long we keep it and how to delete your account is explained in the privacy notice.
3. Acceptable use
We ask you to use the site in good faith. You may not:
- abuse the site or its services, or use them in a way that affects them or other people;
- get around usage limits, such as Capito’s daily limits, for example by using several accounts;
- automate accounts: create them, sign in to them or use them with programs, scripts or services acting on your behalf;
- try to get into accounts, data or parts of the site that are not yours, or test its security without written permission;
- upload or write content that is unlawful, harmful or violates other people’s rights, or use the site to send spam or malicious software.
4. Capito (AI explanations)
- The explanations are generated by a third-party AI (OpenAI) and may contain errors, be incomplete or out of date. Do not treat them as professional, legal, medical or financial advice. Check anything important against other sources.
- For now Capito only covers programming and technology topics. It may decline to answer other topics.
- There are daily limits on explanations and messages per person. They may change.
- Public explanations can be seen by anyone, with or without an account. Private ones are visible only to you. Before making an explanation public, check what it contains.
- Do not write personal or confidential data, yours or anyone else’s, or restricted information from your company. What you write in Capito is stored by ozeida and sent to OpenAI to generate the explanation, as the privacy notice explains.
- ozeida may hide or delete a public explanation that is not appropriate.
5. Intellectual property
- The site and its parts belong to ozeida or, where indicated, to their authors or to whoever licensed them to us: the design, the code, the illustration canon and the illustrations, the courses and tutorials, the texts, the trademarks and logos, and the explanations Capito generates.
- Courses written by invited authors belong to their authors, as the terms for authors say; the illustrations ozeida makes for them belong to ozeida.
- Some elements belong to third parties and are used under their license; they are listed on the credits page.
- These terms give you no right over any of the above, except to use the site as intended: to read, study and use its courses and explanations for your own learning and work, without copying or redistributing them as if they were yours. If you want to use something in another way, write to us at contacto@ozeida.com.
- The names “ozeida”, “ozeida Academy”, “Sprezzatura” and “Capito” may not be used without ozeida’s permission, except to refer to the site.
6. What you write
- You keep what you write on the site, for example your questions and messages in Capito. ozeida does not take over its authorship.
- By writing it you give ozeida a non-exclusive, royalty-free, worldwide permission (license) to store it, process it, send it to OpenAI to generate the explanation and show it as you decide, for example if you make an explanation public. It only serves to run and improve the service the site offers and to keep it secure.
- The permission starts when you write it and lasts while the content is stored or published on ozeida. It ends when you delete it or delete your account, except for the backups and copies explained in the privacy notice, and except for what other people saw or saved while it was public.
- You are responsible for having the right to write what you write.
- For authors’ courses, the permission is the one in the terms for authors.
7. Content extraction and reverse engineering
To protect the work behind the site, the following is prohibited:
- Systematically or automatically extracting content, explanations, illustrations, voices or data from the site, for example by scraping, crawling or bulk download, with programs or with people. Search engines are excepted, within what the site’s robots.txt file allows. AI training robots have no permission over Capito (/academy/capito/).
- Decompiling, disassembling or reverse engineering the site, the player or the API, or trying to obtain their prompts, models, instructions or internal parameters, by any means, including repeatedly questioning Capito for that purpose.
- Using the site’s content to train or improve AI models, or to create a product or service that competes with ozeida’s.
- Getting around the site’s limits, access controls or technical measures, or helping others do so.
If you breach this section, ozeida may suspend or close your account, block access (for example, from an IP address or an automated service) and remove the affected content, without prior notice when needed to protect the site. ozeida also reserves the legal actions that may apply.
If you have a legitimate use in mind, such as research, write to us at contacto@ozeida.com before you start. We may authorize it in writing.
8. No warranty and limitation of liability
- ozeida provides the site “as is”. It does not promise that the site will always be available or error-free, or that its courses or explanations are correct, complete or fit for a particular purpose. How you use them is your responsibility.
- ozeida may change, limit or stop offering parts of the site, including Capito and its limits.
- To the extent the law allows, ozeida is not liable for indirect damages, such as loss of opportunities, income or data, or for what results from relying on an explanation generated by an AI.
- Nothing above limits rights that the law does not allow to be limited.
9. Changes to these terms
- Each version is dated. The current one is the one in the heading.
- If they change, we publish the new version on this page and, for people with an account, we email them the new version. If you keep using the site after that notice, the new version applies.
10. Governing law and jurisdiction
- These terms are governed by the laws of Mexico.
- To resolve any dispute about them, the parties submit to the competent courts of Saltillo, Coahuila, Mexico.
11. Contact
- For any question about these terms, write to us at contacto@ozeida.com.
